Central Election Commission of the Republic of Azerbaijan conducted its session headed by Mr. Mazahir Panahov on November 26, 2005.
Firstly,CEC commissioners reported on the appeals under their execution. CEC adopted decision on sending 3 of the appeals to the Prosecutor’s Office of the Republic of Azerbaijan for the consideration on determination.
Later, Mr. Azer Taghiyev, CEC Commissioner reported on the issue about Constituency and Precinct Election Commissions (Con.ECs and PECs) that allowed shortcomings in their activity during the preparation and conduct of elections. CEC adopted decision on the dismissal of the Con.ECs that allowed shortcomings during the above-mentioned period: Binagadi second Con.EC # 9, Nizami second (Ganja) Con.EC # 38, Sumgayit second Con.EC # 42, Zagatala Con.EC # 110, Aghdam village Con.EC # 119 and Zangilan-Gubadli Con.EC # 125. Furthermore, decision was adopted on the dismissal of some PECs.
Mr. Fuad Javadov, CEC Commissioner reported on the issue of sending the materials with the probability of crime defined by CEC as the result of the investigation to Prosecutor’s Office of the Republic of Azerbaijan. CEC adopted decision on sending the above-mentioned materials of 29 PECs to the Prosecutor’s Office of the Republic of Azerbaijan.
At the session, current issues were also considered.
At the CEC session, representatives of the USA embassy and IFES (International Foundation for Election Systems), as well as representatives of domestic and foreign mass media also took part.

Central Election Commission of the Republic of Azerbaijan (CEC) conducted its session headed by Mr. Mazahir Panahov on November 23, 2005.
Firstly, CEC Chairman put into discussion the issue on the compilation of protocols on general electoral results by CEC related to third call Elections to the Milli Majlis of the Republic of Azerbaijan conducted on November 6, 2005, on the check of election returns and sending the protocols of Constituency Election Commissions (Con.ECs) to the Constitutional Court of the Republic of Azerbaijan together with the documents attached to them for the approval. CEC Chairman stated that pursuant to Article 171.2 of Election Code of the Republic of Azerbaijan, CEC shall check Con.EC protocols together with the attached documents within at latest 20 days after the voting day and submit them to the Constitutional Court within 48 hours. Within the period determined by law since the voting day, 538 appeals entered to CEC and these appeals were considered pursuant to the requirements of “Instruction on the rules for the consideration of the appeals on suffrage violation entered election commissions” approved on the basis of the recommendations by Venice Commission of the Council of Europe. In general, election results on 460 precincts were considered invalid. CEC considered invalid elections on 4 constituencies. Consideration of electoral results invalid on some polling stations in 2 constituencies influenced electoral returns on these constituencies and the persons considered elected deputies were changed. Investigation of all appeals submitted to CEC and check of Con.EC protocols have already been ended and today it is possible to send the above-mentioned documents to the Constitutional Court.
Majority of CEC commissioners who made report later noted that Elections to the Milli Majlis of the Republic of Azerbaijan were conducted pursuant to law and electoral results were generally sufficient excluding some shortcomings. Commissioners stated that this opinon was also emphasized by many influential international observers.
CEC Chairman also shared the ideas of these commissioners that head of the state played exceptional role in the conduct of elections under normal conditions. Mr. President did his best for the conduct of Elections to the Milli Majlis inder transparent, democratic and legal conditions by his orders dated on May 11 and October 25, 2005, as well as by his steps of state importance. CEC Chairman stated about the assistance of many state bodies in this field. At the end of his speech, Mr. Panahov expressed his great thanks to Mr. Ilham Aliyev, President of the Republic of Azerbaijan. More later, he also thanked representatives of mass media for lightening of elections and state bodies which helped in election process.
The issue included was put in vote. By being 11 persons for and 4 persons against, decision was adopted on the compilation of the protocol on general election results by CEC related to Elections to the Milli Majlis of the Republic of Azerbaijan conducted on November 6, 2005, check of electoral returns and submission of Con.EC protocols to the Constitutional Court of the Republic of Azerbaijan together with the documents attached to them.

At the session, the issue on the appeals entered the commission and on the voting results on some constituencies and current issue was put into discussion. Firstly, CEC commissioners reported on the appeals under their execution. CEC adopted decision on the consideration of the voting results on some PECs of Narimanov first Con.EC # 19, Gadabay Con.EC # 103, Sumgayit-Absheron Con.EC # 44, Khatai third Con.EC # 35, Yevlakh-Mingachevir Con.EC # 49, Mingachevir Con.EC # 47, Surakhani first Con.EC # 30, Yasamal third Con.EC # 17, Neftchala Con.EC # 61, Salyan-Neftchala Con.EC # 60, Khachmaz village Con.EC # 56, Gusar Con.EC # 51, Guba-Gusar Con.EC # 53, Bilasuvar Con.EC # 66, Gobustan-Khizi-Guba Con.EC # 50 and Sabail Con.EC # 29 invalid because of unaffordable amendments made in the protocols on voting results on precincts, as well as because afforded law violations did not allow voters to determine their will.
Furthermore, a decision was adopted on sending the complaints entered related to the precincts # 14, 31 and 34 in Neftchala Con.EC # 61 to the Prosecutor’s Office of the Republic of Azerbaijan for the consideration on determination.
At the session, current issues were also considered.

Mr. Ramiz Ibrahimov, CEC Commissioner reported on the voting results in Nizami second (Ganja) Con.EC # 38 in Elections to the Milli Malis of the Republic of Azerbaijan on November 6, 2005 and on the appeals entered CEC related to the elections conducted in this Con.EC.
Because of irregularities determined in the protocols on voting results in PECs # 2, 4, 7, 8, 9, 14, 16, 17, 21, 22 and 24 of Nizami second (Ganja) Con.EC # 38, as well as because afforded law violations did not allow voters to determine their will, CEC adopted decision on the consideration of voting results in these PECs invalid.
Furthermore, as the number of polling stations where the voting results have been considered invalid on the constituency constitutes more than 2/5 of total number of polling stations from this constituency and the number of registered voters in this precinct constitutes more than ¼ of total number of the voters registered on the constituency, the voting results in Nizami second (Ganja) Con.EC # 38 were considered invalid.
At the session, current issues were also considered.

Mr. Ilham Mammadov, CEC Commissioner reported on the voting results in Zagatala Con.EC # 110 in Elections to the Milli Malis of the Republic of Azerbaijan on November 6, 2005 and on the appeals entered CEC related to the elections conducted in this Con.EC.
Because of irregularities determined in the protocols on voting results in PECs # 1, 2, 6, 8, 10, 15, 17, 19, 20, 22, 24, 25, 26, 31, 33, 34, 36, 37 and 40 of Zagatala Con.EC # 110, as well as because afforded law violations did not allow voters to determine their will, CEC adopted decision on the consideration of voting results in these PECs invalid.
Furthermore, as the number of polling stations where the voting results have been considered invalid on the constituency constitutes more than 2/5 of total number of polling stations from this constituency and the number of registered voters in this precinct constitutes more than ¼ of total number of the voters registered on the constituency, the voting results in Zagatala Con.EC # 110 were considered invalid.

Central Election Commission of the Republic of Azerbaijan (CEC) conducted its session headed by Mr. Mazahir Panahov on November 8, 2005.
Firstly, CEC Chairman stated that Elections to the Milli Majlis on November 6, 2005 were conducted pursuant to the requirements of orders by President of the Republic of Azerbaijan dated on May 11 and October 25, 2005. he also noted that besides indicating some shortcomings, many international observers also expressed that the elections generally were conducted in sufficient level.
Later, Mr. Natig Mammadov, CEC Secretary reported on the issue of the results in Surakhani second Con.EC # 31 and Sumgayit second Con.EC # 42 and he informed about the appeals entered CEC related to the results of these Con.ECs. CEC adopted decision on the consideration of the voting results in precincts # 8, 13, 17, 18, 20, 22, 23, 24, 25 and 28 of Surakhani second Con.EC # 31 invalid because of unaffordable amendments made in the protocols on voting results on precincts, as well as because afforded law violations did not allow voters to determine their will. It was also decided to send relevant materials on this constituency to the Prosecutor’s Office of the Republic of Azerbaijan on determination for the investigation, as well.
CEC also adopted decision on the consideration of voting results on Sumgayit second Con.EC # 42 invalid and sending relevant materials on this constituency to the Prosecutor’s Office of the Republic of Azerbaijan on determination for the investigation.
Mr. Ramiz Ibrahimov, cec commissioner reported on the voting results in Binagadi second Con.EC # 9 and appeals entered cec related elections in this constituency. CEC adopted decision on the consideration of voting results on Binagadi second Con.EC # 9 invalid and sending relevant materials on this constituency to the Prosecutor’s Office of the Republic of Azerbaijan on determination for the investigation.
At the session, current issues were also considered.

Central Election Commission of the Republic of Azerbaijan (CEC) conducted its session headed by Mr. Mazahir Panahov on November 1, 2005.
Firstly, session minutes by the Commission dated on September 29, September 5, September 8 and October 11, 2005 were approved.
Later, Mr. Natig Mammadov, CEC Secretary reported on the draft of “Instruction on the rules for the consideration of the appeals entered election commissions related to the violation of suffrage”. CEC adopted decision on the approval of this document.
Mr. Vidadi Mahmudov, another CEC Secretary reported on the issue of making appendices to the “List of identification documents used in the voting by the citizens of the Republic of Azerbaijan and persons without citizenship who have the right to participate in Elections to the Milli Majlis of the Republic of Azerbaijan”, approved by CEC decision # 32/148 dated on October 5, 2005. By CEC decision, reference in Soviet passport and form # 9 were also attached to this list.
The Commission adopted decisions on making changes in the compositions of the Babek-Kangarli Con.EC # 3, Binagadi second Con.EC # 9, Hajigabul-Kurdamir Con.EC # 58, Shaki first village Con.EC # 114 and Jabrayil-Gubadli Con.EC # 120.
Appeals entered CEC were also discussed, one of these appeals was sent to the relevant Con.EC for investigation, one appeal was sent to the Ministry of Interior Affairs and one of them was sent to Baku city Prosecutor’s Office.
At the session, current issues were also considered.
At the CEC session, experts of OSCE/ODIHR, Venice Commission of the Council of Europe and representatives of IFES (International Foundation for Election Systems), domestic and foreign mass media also took part.
